Both entities can potentially affect the status of a DUI defendant’s driver license. Not every lawyer has the training necessary to effectively defend a drunk driving case. To preserve your right to present a defense with the Department of Motor Vehicles, you MUST request a DMV hearing (commonly known as an “Admin Per Se” or “APS” hearing) within 10 days of arrest. If you request a DMV hearing within 10 days of arrest, the DMV will stay (delay) your license suspension pending the outcome of the hearing. If you retain my office prior to the 10 day deadline, we will request the hearing for you.
